Terms of Service

These Terms of Service ("Terms") are an agreement between you and LBAPS National ("LBAPS," "we," "us," or "our") governing your use of MomVersity, the platform available at lbapsnational.com (the "Service"). By creating an account, enrolling, or otherwise using the Service, you agree to these Terms and to our Privacy Policy. If you do not agree, do not use the Service.

1. The Service

MomVersity provides Applied Behavior Analysis (ABA) parent training delivered by licensed and credentialed clinicians (BCBAs and RBTs) through live video sessions on Zoom, together with a learning hub, curriculum materials, assessments, individualized learning pathways, progress tracking, and Spark, an AI-powered assistant. Covered services are billed through insurance under CPT codes 97151, 97153, 97155, 97156, and 97157, subject to your plan's coverage.

2. Eligibility and Accounts

• You must be at least 18 years old and the parent or legal guardian of the child receiving services, or an authorized clinical or staff user, to hold an account.
• You agree to provide accurate, current, and complete information during enrollment and to keep it up to date — including your contact and insurance information.
• You are responsible for safeguarding your login credentials and for all activity under your account. Clinical and staff roles are required to use multi-factor authentication. Notify us immediately at [email protected] if you suspect unauthorized access.

3. Enrollment and Insurance Billing

• Enrollment includes verification of your insurance eligibility with your payer. Some plans require prior authorization before services begin; we will work with your payer to obtain it, and services may be delayed until authorization is granted.
• You are responsible for the accuracy of the insurance information you provide. Coverage determinations are made by your insurance payer, not by us. You are responsible for amounts your plan does not cover, such as copays, coinsurance, and deductibles, as determined by your plan.
• Tell us promptly if your coverage changes; lapsed or changed coverage may interrupt services.

4. Payments and Subscriptions

• Optional paid features, such as the AI Chat Premium subscription, are billed through Stripe. By purchasing, you authorize recurring charges to your payment method at the stated price until you cancel.
• You can manage or cancel subscriptions at any time from the billing page in the Parent Portal, which opens the Stripe customer portal. Cancellation takes effect at the end of the current billing period; fees already paid are non-refundable except where required by law.
• Prices for optional features may change with advance notice.

5. Not Medical Advice; Emergencies

The Service delivers parent training and educational support. Content in the learning hub, curriculum, assessments, and chat is provided for education and skill-building and is not a substitute for individualized medical, psychological, or clinical advice, diagnosis, or treatment. Always consult your child's treating professionals about their specific needs. If you or your child is experiencing a medical or mental-health emergency, call 911, or call or text 988 (Suicide & Crisis Lifeline). Do not use the Service to seek emergency help.

6. AI Assistant

Spark, our AI assistant, generates responses automatically using third-party language-model providers. Its responses may be incomplete or inaccurate and do not constitute clinical advice or the opinion of your care team. Verify important information with your clinician. Messages are screened by automated moderation for safety, and fair-use limits apply to premium chat features.

7. Session Recordings

Live sessions may be recorded for clinical documentation, quality assurance, and supervision. Participants are informed before recording begins, and recordings are handled as described in our Privacy Policy. By participating in a session after being informed of recording, you consent to the recording. You may not record sessions yourself or redistribute recordings without our written permission.

8. Acceptable Use

You agree not to:

• use the Service unlawfully or in violation of these Terms, or impersonate another person;
• share your account, or access another person's account or data without authorization;
• copy, scrape, download in bulk, resell, or publicly redistribute curriculum materials, lessons, recordings, or other content from the Service;
• interfere with the Service's operation, probe or circumvent its security or access controls, or introduce malicious code;
• use the Service or the AI assistant to generate or transmit content that is unlawful, harassing, or harmful;
• use the Service to build a competing product or train machine-learning models on its content.

9. Intellectual Property

The Service and its content — including the curriculum, lessons, videos, assessments, learning pathways, software, and branding — are owned by LBAPS National or its licensors and are protected by copyright and other intellectual-property laws. We grant you a limited, non-exclusive, non-transferable license to access and use the Service and its materials for your family's personal, non-commercial use while your account is active. You retain ownership of the information you submit to the Service and grant us the license needed to operate the Service as described in these Terms and the Privacy Policy.

10. Third-Party Services

The Service relies on third-party providers — including Zoom for live sessions, Stripe for payments, Google for optional sign-in and calendar sync, and Availity for insurance eligibility — and may link to third-party sites. Your use of a third party's service is governed by that party's own terms and privacy policy, and we are not responsible for third-party services we do not control.

11. Termination

You may stop using the Service or request account closure at any time by contacting [email protected]. We may suspend or terminate your access if you materially violate these Terms, if required by your payer or by law, or if we discontinue the Service, in which case we will give you reasonable notice where practicable. Clinical and billing records are retained after termination as required by law. Sections of these Terms that by their nature should survive termination (including Sections 9 and 12–15) survive.

12. Disclaimer of Warranties

Except as expressly stated in these Terms, the Service is provided "as is" and "as available." To the fullest extent permitted by law, we disclaim all warranties, express or implied, including merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Service will be uninterrupted, error-free, or secure, or that any particular clinical outcome will be achieved. Nothing in this section limits the professional obligations of licensed clinicians providing services.

13. Limitation of Liability

To the fullest extent permitted by law, LBAPS National and its officers, employees, and agents will not be liable for indirect, incidental, special, consequential, or punitive damages, or for lost profits or data, arising out of or related to your use of the Service. Our total liability for all claims arising out of these Terms or the Service will not exceed the greater of one hundred U.S. dollars ($100) or the amounts you paid us for optional paid features in the twelve months before the claim arose. These limitations do not apply to liability that cannot be limited by law, including liability arising from professional clinical services, gross negligence, or willful misconduct.

14. Indemnification

You agree to indemnify and hold harmless LBAPS National from claims, damages, and expenses (including reasonable attorneys' fees) arising from your violation of these Terms or your unlawful use of the Service, except to the extent caused by our own conduct.

15. Governing Law and Disputes

These Terms are governed by the laws of the State of New York, without regard to its conflict-of-law rules. Any dispute arising out of these Terms or the Service that cannot be resolved informally will be brought exclusively in the state or federal courts located in New York, and you consent to their jurisdiction. Before filing a claim, you agree to contact us at [email protected] and give us 30 days to work with you to resolve the dispute informally. Nothing in this section limits rights you may have under applicable health-insurance or consumer-protection law.

16. Changes to These Terms

We may update these Terms from time to time. If we make material changes, we will notify you by email or through a prominent notice in the Service before the changes take effect, and we will update the effective date at the top of this page. Your continued use of the Service after changes take effect constitutes acceptance of the updated Terms.
